1. Acceptance of Terms

By accessing or using Catalogador ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all users of the Service, including without limitation users who are browsers, registered users, and contributors of content.

These Terms constitute a legally binding agreement between you and Catalogador, with registered office in Spain. If you are entering into these Terms on behalf of a company or organization, you represent that you have authority to bind that entity.

3. Description of Service

Catalogador is a personal collection management application that allows users to:

  • Catalog and organize personal collections (books, movies, music, games, etc.)
  • Track items lent to others (loans management)
  • Search and browse their collections
  • Import and export collection data
  • Access metadata lookup services for automatic data population
  • Track progress on books, movies, and other media

The Service is provided free of charge for personal, non-commercial use. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.

4. User Accounts

Account Creation

To use certain features of the Service, you must register for an account. When you register, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your password
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

Age Requirements

In accordance with EU GDPR and Spanish law (LOPDGDD), you must be at least 14 years old to create an account. If you are under 14, you may only use the Service with parental or guardian consent.

Account Termination

We may terminate or suspend your account if you breach these Terms. You may also delete your account at any time through your account settings. Upon termination:

  • Your right to use the Service will cease immediately
  • You may request export of your data before deletion
  • We will delete your personal data within 30 days, subject to legal retention requirements

5. User Content

Ownership

You retain full ownership of all content you submit, post, or display on or through the Service ("User Content"). By submitting User Content, you grant us a limited, non-exclusive, worldwide, royalty-free license to use, copy, and process that content solely for the purpose of providing the Service to you.

Your Responsibilities

You are solely responsible for your User Content. You represent and warrant that:

  • You own or have the necessary rights to use and share the content you submit
  • Your content does not violate any third-party rights (including intellectual property rights)
  • Your content is accurate and not misleading
  • Your content complies with all applicable laws

Prohibited Content

You agree not to upload, post, or transmit content that:

  • Is illegal, harmful, threatening, abusive, harassing, defamatory, or discriminatory

We reserve the right to remove any content that violates these Terms and to suspend accounts that repeatedly violate these rules.

  • Interfere with or disrupt the Service, servers, or networks

The Service and its original content (excluding User Content), features, functionality, design, and underlying technology are and will remain the exclusive property of Catalogador and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws of Spain, the European Union, and international treaties.

Our trademarks, logos, and service marks ("Marks") may not be used in connection with any product or service without our prior written consent. All other trademarks not owned by us that appear on the Service are the property of their respective owners.

8. Third-Party Services

The Service may contain links to or integrate with third-party websites, services, or APIs that are not owned or controlled by Catalogador (e.g., metadata providers for books, movies, music).

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party services. You acknowledge and agree that Catalogador shall not be responsible or liable for any damage or loss caused by the use of such external services.

Your use of third-party services is governed by their respective terms of service and privacy policies.

9. Data Protection

We are committed to protecting your personal data in accordance with the EU General Data Protection Regulation (GDPR) and Spanish Organic Law 3/2018 on Personal Data Protection (LOPDGDD).

By using the Service, you acknowledge that you have read and understood our Privacy Policy and consent to the processing of your data as described therein.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the maximum extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free. We do not warrant the accuracy or reliability of any information obtained through the Service, including metadata from third-party sources.

Note: Under EU consumer law, these limitations do not affect your statutory rights as a consumer, including rights under the Consumer Rights Directive (2011/83/EU) and national implementing legislation.

11. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Catalogador, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:

  • Loss of profits, data, use, goodwill, or other intangible losses
  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content
Consumer Rights: This limitation of liability does not affect your statutory rights as a consumer under EU and Spanish law. Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless Catalogador and its licensees, licensors, employees, contractors, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt arising from:

  • Your use of and access to the Service
  • Your violation of any term of these Terms
  • Your violation of any third-party right, including intellectual property rights
  • Any claim that your User Content caused damage to a third party

This indemnification obligation will survive the termination of these Terms and your use of the Service.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will:

  • Provide at least 30 days' notice before new terms take effect
  • Notify registered users via email
  • Display a prominent notice on our website
  • Update the "Last updated" date at the top of this page

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service and delete your account.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions, and in compliance with applicable European Union law.

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Spain.

Consumer Rights

15. Consumer Rights Under EU Law

As a consumer in the European Union, you have certain rights that cannot be waived by contract:

Digital Content Rights

Under EU Directive 2019/770 on digital content and digital services:

  • You have the right to digital content/services that conform to the contract
  • We must provide updates necessary to keep the Service in conformity
  • You have remedies available if the Service does not conform to these Terms

Right of Withdrawal

Since Catalogador is a free service, the standard 14-day withdrawal period for paid digital services does not apply. However, you may stop using the Service and delete your account at any time.

Data Protection Rights

Your data protection rights under GDPR are detailed in our Privacy Policy, including your right to access, rectify, delete, and port your data.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole. Such provisions shall be deleted without affecting the remaining provisions herein.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Catalogador regarding your use of the Service and supersede all prior agreements and understandings.
